I was thinking that instead of having streets deserted at night there ought to be guards patrolling the streets. If the PC goes on a midnight shopping spree there should be more guards. Guards should attack any monsters that come into town. This came to mind because currently if you are in a house ...

I agree with this one, too, but I don't see this as a problem. This is a game. If you make a mistake, die, make a key quest target vanish, (get overindebted,) you have the option to load (or even edit) a save game. That's just how it is. I think this is basically a good idea.
For loitering, there seems to be a consensus.

For resting, simulating the outside world - without displaying it to the player - would be a good addition because of problems like determining if you got caught when resting where you were not supposed to.

Yeah, this whole rest vs. loiter choice leading to "accidental" criminal charges has been discussed before, and is another example of poor UI design on classic Daggerfall's part. Yep. Though I wouldn't say it's just the ui. You can tell that they were really reaching to expand the crime system here...
